Merritt Walking Sightseeing App Policy Agreement

Introduction

Welcome to the Merritt Walking Sightseeing App (“the App”). By using the App, you agree to comply with and be bound by the following terms and conditions (“Policy Agreement”). Please read this Policy Agreement carefully before using the App. If you do not agree with any part of this Policy Agreement, you must not use the App.

1. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by this Policy Agreement and our Privacy Policy. This Policy Agreement applies to all users of the App, including but not limited to users who are browsers, vendors, customers, merchants, and/or contributors of content

2. User Accounts

Registration: To use certain features of the App, you may be required to register and create an account. You must provide accurate and complete information during the registration process and keep your account information up-to-date.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Eligibility: By using the App, you represent and warrant that you are at least 18 years old. If you are under 18, you may use the App only with the involvement of a parent or guardian.

3. User Conduct

Prohibited Activities: You agree not to engage in any of the following activities: Violating any applicable laws or regulations. (a) Posting or transmitting any content that is defamatory, obscene, offensive, or otherwise objectionable. (b) Interfering with or disrupting the App or servers or networks connected to the App. (c) Attempting to gain unauthorized access to any portion of the App or any other accounts, computer systems, or networks connected to the App.

User Content: You retain ownership of any content you submit, post, or display on or through the App. By submitting content, you grant us a non-exclusive, royalty-free, worldwide, transferable, sub-licensable license to use, reproduce, modify, create derivative works from, distribute, and display your content in connection with the App.

4. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection, use, and sharing of information as described in our Privacy Policy.

5. Intellectual Property

Ownership: The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by the Merritt & Nicola Valley Destination Marketing Society, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use.

6. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the App will be uninterrupted or error-free.

7. Limitation of Liability

In no event shall the Merritt Walking Sightseeing App, its affiliates, licensors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; (iv) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the App, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Changes to the Policy Agreement

We reserve the right to modify this Policy Agreement at any time. Any changes will be effective immediately upon posting the revised Policy Agreement on the App. Your continued use of the App following the posting of changes constitutes your acceptance of such changes.

9. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach this Policy Agreement and/or fail to maintain your Experience Merritt Membership. Upon termination, your right to use the App will immediately cease.

10. Governing Law

This Policy Agreement and any dispute or claim arising out of, or related to, it shall be governed by and construed in accordance with the internal laws of the province or country in which Merritt Walking Sightseeing App is headquartered without giving effect to any choice or conflict of law provision or rule.
